Massachusetts Department of Environmental Protection (DEP)
DEP’S Bureau of Waste Site Cleanup provides technical support to parties seeking to cleanup and redevelop contaminated property including assistance in complying with clean-up laws and regulations.

Massachusetts Department of Business and Technology / Massachusetts Office of Business Development (DBT / MOBD)
Offers a broad range of business support services.

Massachusetts Department of Housing and Community Development (DHCD)
Administers housing, community and economic development programs that support the development or redevelopment of project areas that may contain brownfields.

U.S. Environmental Protection Agency (EPA)
Works with communities and other stakeholders in economic development to prevent, assess, safely clean up, and sustainably reuse brownfields.

U.S. Department of Housing and Community Development (HUD)
Dedicated staff and resources who understand how to access brownfields programs, directed mostly at housing issues. Programs are designed to leverage private sector investment and to provide critical funding to neighborhoods in need.

U.S. Army Corps of Engineers
Provides communities with technical assistance to assess and evaluate contamination issues as they arise in conjunction with projects involving the nation’s water and related environmental resources.

Office of the Massachusetts Attorney General
Administers the Massachusetts Brownfields Covenant Not to Sue Program which offers liability relief beyond that which is already statutorily provided.

Massachusetts Department of Revenue (DOR)
Administers the Massachusetts Brownfields Tax Credit Program which offers eligible taxpayers a credit against their tax liability for the costs incurred to rehabilitate contaminated property owned or leased for business purposes and located within an economically distressed area.

Business Development Corporation of New England
Administers the Brownfields Redevelopment Access to Capital Program on behalf of the state. The program helps to eliminate environmental risk associated with brownfields redevelopment by making low-cost, state-of-the-art and often state-subsidized environmental insurance available. BDC also offers financing programs for projects.

Licensed Site Professionals
Private professionals who analyze the environmental condition of a property, determine the appropriate approach to cleanup, oversee and implement the cleanup, and ensure compliance with environmental laws. Known as “Licensed Site Professionals” or “LSPs,” these technical experts are licensed by the Commonwealth and rules govern their conduct.

Legal Assistance
Understanding the responsibilities associated with owning a brownfields property is important. The Massachusetts Bar Association can provide a referral for legal counsel when needed. The selected real estate lawyer should be familiar with the August 1998 Brownfields legislation and programs.

Accountant Assistance
Prior to agreeing on acquisition price or evaluating cleanup costs, consult an accountant or lawyer who can advise you correctly on the brownfields tax incentives and other costs issues. The Massachusetts Society of Certified Public Accountants, Inc. provides assistance in identifying a CPA.
